ORDER

1. Punjab National Bank had filed the suit for the recovery of Rs.31,58,263/- with interest against M/s Nand Traders and others (defendants) in the Ld. District Judge, Jammu. Vide order dated 28.04.2023, this suit was transferred by the Court of Additional District Judge, Jammu, to DRT-1, Chandigarh.

2. Bank’s case is that in the year 2010, it had granted a C.C. limit of Rs.25.00 Lacs to defendant No.1 through defendant No.2 and defendant

No.3 for business purpose. Defendant No.4 had stood guarantor. To secure the loan, Defendant No.2 and 4 had mortgaged their properties and stocks fully detailed in para-No.7 of the plaint (Annexure E). The loan was chargeable to interest @12.25% per annum with monthly rests. On 01.12.2013, a sum of Rs.31,58,263/- was due from the defendants. Despite repeated requests, defendants did not make the repayment. Hence, this suit.

3. On 18.10.2016, Defendants No.1 to 3 had filed their written statement wherein they alleged that the suit had not been filed by the competent person; defendants were not allowed to go through the loan documents and were forced to execute the documents under pressure and misrepresentation of facts; bank being in dominant position made the defendants to sign the Deed of Guarantee. They further state that the bank filed the present suit without declaring the loan account of the defendants as NPA. On 03.02.2025, this Tribunal sent summonses to the defendants by registered post, which were duly served. However, defendants did not put in appearance. Vide order dated 05.08.2025, they were proceeded ex parte.

4. In order to prove its case, the Bank has placed on record the affidavit of Sh. Piara Lal Moten, Manager along with the loan and original security documents.

5. I have perused the evidence on the record. I am of the considered view that the Bank has proved its case that it had advanced the loan of Rs.25.00 Lacs and on 01.12.2013, a sum of Rs.31,58,263/- was due.

6.
