DEBTS RECOVERY TRIBUNAL-I, CHANDIGARH

RA/5/2024 IN OA/836/2016

PUNJAB NATIONAL BANK

Vs

M/S ALPINE PRESSURE COOKER AND KITCHENWARE PRIVATE LTD

**17.07.2026**

Item No.160

Present: Mr. Puneet Sharma, Counsel for the Applicant. Mr. R.S. Bhatia, Counsel for respondent Bank.

Brajesh Nakra (Defendant No.7) in OA No.836 of 2016 has filed the present application seeking review of the judgment dated 16.05.2023, whereby this Tribunal had allowed OA No.836 of 2016 filed by Punjab National Bank against him and the other defendants for the recovery of Rs.2,53,92,177.53p.

The present review application was filed on 16.01.2024. Along with the review application, applicant had also filed an application under Section 5 of the 'Limitation Act seeking condonation of delay of 166 days.

I am of the considered view, that there is no necessity to state the facts, as the Hon'ble Supreme Court, in **Standard Chartered Bank v. MSTC Limited, (2020) 13 SCC 618**, has held that the Debts Recovery Tribunal has no jurisdiction to condone the delay in filing a review application under Rule 5A of the Debts Recovery Tribunal (Procedure) Rules.

In view of the law laid down by the Hon'ble Supreme Court that no application for condonation of delay in filing a review application is maintainable, I am of the considered view, that the present application under Section 5 of the Limitation Act is not maintainable. Consequently, the review application is also rejected.

File be consigned to record room after due compliance.
