DEBTS RECOVERY TRIBUNAL-I, CHANDIGARH

MA/30/2026 In SA No. 08/2026 AMIT ATWAL Vs CANARA BANK

27.08.2026 Item No.259

Present: Mr. Mehul Khanna, Counsel for the Applicant (on vc).

None for the defendants.

Applicant has filed this application for refund of the penalty charges and NPA post expenses etc. Admittedly, Applicant is an Ex-employee of Canara Bank, who had raised some loan from the bank. He committed some acts of omission and commission, which was wholly not related to his loan account. However, the bank has declared the account of the applicant NPA and initiated the SARFAESI action.

I am of the considered view that the applicant should have claimed all these relief in SA No. 08/2026 filed by him. Applicant cannot be allowed to bifurcate the claim. I am of the considered view that the application is wholly misconceived. The same is hereby dismissed.

File be consigned to the record room after due compliance.

(A S Narang) Presiding Officer DRT-I, Chandigarh
