DEBTS RECOVERY TRIBUNAL-I, CHANDIGARH
RA/10/2026
Dalbir Kaur
Versus
Samman Capital Limited (formally known as Indiabulls Housing Finance Limited)
**07.09.2026**
Item No.25
Present: Mr.Arshdeep Singh Khaira, Counsel for RA Applicant. Mr.Rohit Sapra, Counsel for respondent FI.
Dalbir Kaur (Applicant) has filed this Review Application for recalling the order dated 18.08.2026 passed by this Tribunal in SA No. 236/2026.
*Vide* order dated 18.08.2026, this Tribunal had passed the following order:- *"Mr.Sapra submitted that the present SA has not been filed by a duly authorized person. This SA has been filed by Dalbir Kaur, through her special power of attorney Gursharan Singh. It has been brought to my notice that this special power of attorney pertains to some other property for filing a civil suit. In this power of attorney Dalbir Kaur has not authorized Gursharan Singh to file the present SA. Further, the power of attorney does not mention the date of execution and the same has not been notarized/attested.*
*Since, Gursharan Singh has not been authorized to file the present SA, I hereby dismiss the same. Applicant may well file a fresh SA in case it is permissible under the law. All the pending IAs, if any, are also disposed of, accordingly.*
*File be consigned to the record room after due compliance".*
On 05.09.2026, Applicant filed the present Review Application for recalling the order dated 18.08.2026 passed by this Tribunal.
Respondent, in the reply, has denied the case of the Applicant.

Mr.Khaira, counsel for the applicant has placed reliance on the judgment passed by the Hon'ble Supreme Court in *Jugraj Singh and another versus Jaswant Singh and others; [1971] 1 S.C.R., decided on 16.03.1970.*
It is admitted on the record that in SA No. 236/2026 filed by the applicant, in the power of attorney given by her to Gursharan Singh, she had not authorized Gursharan Singh to file the SA. The property involved in the present case was also not mentioned in the power of attorney. The power of attorney was not authorized/ notarized. There is no error apparent on the face of record.
In view of this, I am of the considered view that there is no ground to review the order dated 18.08.2026. There is no merit in the present RA, the same is hereby **dismissed**. All the pending IAs, if any, are also disposed of, accordingly.
File be consigned to the record room after due compliance.
Pronounced in open court MANOJ
