Court of the Presiding Officer Debts Recovery Tribunal-1, Chandigarh Case M.A. No. 42 of 2020 (Item No. 31) Axis Bank Vs Gurmej Singh 22.01.2021 Present through V.C.

Sh. D.K. Singhal, Counsel for Applicant Bank The matter was taken for hearing on M.A., which is filed in the O.A. No. 1170/2019. This M.A. is filed with a prayer of issuance of Recovery Certificate in terms of Judgement/Order dt. 19.03.2020 passed by my Ld. Predecessor in O.A. No. 1170/2019. Ld. counsel for Applicant argued that vide Order dt. 19.03.2020, the O.A. No. 1170/2019 was decided finally and both the parties were directed to appear before the Recovery Officer on 21.05.2020 but on account of countrywide lockdown from 23.03.2020, the service remains suspended. Ld. counsel for Applicant further argued that as per information of Ld. Recovery Officer, Recovery Certificate has not been issued till date. Heard the arguments. Perused the Judgement/Order dt. 19.03.2020 passed by my Ld. Predecessor and it seems necessary to issue Recovery Certificate in the matter. Accordingly, the prayer is allowed and the M.A. stands disposed. Issue Recovery Certificate accordingly. (Vivek Saxena) Presiding Officer DRT, Jaipur (Additional Charge DRT-1 Chandigarh)
