DEBTS RECOVERY TRIBUNAL-I, CHANDIGARH

MA 02/2021 SOHIT SHARMA VS. DEWAN HOUSING FINANCE CORPORATION LTD.

20.01.2021 Item No.50

Present: Adv. IS Bhatia, Counsel for the applicant.

None for respondent bank.

This Miscellaneous Application is filed in SA No.94/2020 by the applicants praying to set aside the order dated 04.01.2021. Heard arguments of applicant that the SA No.94/2020 was fixed for arguments through VC on 04.01.2021 but as they failed to connect for hearing through VC link and due to defective internet line on the system the applicant also sent her message to Sh. Raj Kumar the Court Master during the meeting session informing that due to technical fault he could not connected for the hearing. I had perused the order dated 04.01.2021 passed by my Ld. Predecessor. The SA was disposed of as dismiss in default as no one appeared on behalf of the applicant even on last date. Nowadays cases are being heard through VC also and this is quite possible that on account of certain technical difficulty either party may have failed to connect through internet link and therefore I am of the view that considering the principles of natural justice an opportunity can be granted to the applicant. Accordingly this Miscellaneous Application is allowed. The SA is allowed to be taken on record subject to payment of cost of Rs.5000/- payable to the DRT BAR Association within 15 days. Since this MA is allowed SA be restored to its original number. Copy of this order be placed in SA file. List the SA on 18.02.2021.
