MA 37/2020 HARINDER KAUR VS. UBI Date: 20.03.2021 Present: Shri. Amardeep Singh, Counsel for the Applicant None for the respondent bank. Matter heard through VC from my Office Chamber in DRT Jaipur. This Miscellaneous Application is filed by the applicant in OA No.1243/2019 in which they are defendants and the OA was decided by my Ld. Predecessor on 21.09.2019 as ex parte. The present applicant Sh. Harinder Kaur wife of Sh. Baldev singh filed this MA with a prayer that the ex parte order dated 21.09.2019 passed by my Ld. Predecessor may be set aside and an opportunity be granted to them to file reply of OA No.1243/2019. Perused the grounds of the Miscellaneous Application and heard arguments. I am of the view that an opportunity can be granted to the applicant to file reply to the OA by imposing following conditions: the application will deposit an amount of Rs.10.00 lacs within one month time from today, failing which this MA will be treated disposed of as dismissed. If the applicant deposit the amount of Rs.10.00 lacs within one month time from today, the OA will be restored to its Original number. With these observations the MA stands disposed of.
