Present applicant, is respondent, as Auction purchaser, of the mortgaged property.

This MA is filed, with a prayer of modification of order dated 18/03/2021, to the extent that the observation be removed, as respondent bank, is not giving peaceful possession of the mortgaged property, purchased by him, through auction.

The observation is as under:-

On account of refusal of respondent bank, this MA was filed seeking possession, after appropriate modification in the order dt. 18/03/2021.

Heard arguments and perused the record it’s a fact, that all the applicant in SA no. 103/2018 and present auction purchaser are family member but as SA was dismissed on account of limitation, so the auction purchaser, present applicant is entitled to get possession of the property, in question, purchased, by him.

Perusal of letter dt. 23/03/2021, (Annexure A/2) written by the MA, applicant to the respondent bank, goes to show that Court of the Presiding Officer Debts Recovery Tribunal-I, Chandigarh
