DEBTS RECOVERY TRIBUNAL-I CHANDIGARH

NDN/144/2019 RANJIT SINGH VS. SBOP

21.12.2021 Item No.45

Present: None.

Registry has placed this matter before the undersigned stating that the applicant/defendants have not removed the defects till date.

I have gone through the application. The application has been filed by the applicant under Order 9 Rule 7 of CPC for setting aside order dated 22.01.2019, passed in OA No.2210/2017. The true copy of order dated 22.01.2019 has already been annexed as Exhibit P-1. Record reveals that the said OA has already been allowed by Hon’ble Presiding Officer vide order dated 23.01.2019. Since the matter has already been disposed off, therefore, application under Order 9 Rule 7 is not maintainable.

Rule 5(4) of the Debts Recovery Tribunal (Procedure) Rules, 1993 empowers the Registrar to decline to register an application if the same is not in order or if the applicant fails to rectify the defects within the reasonable time. Accordingly, thisapplication is hereby declined to register being not maintainable. Copy of order be uploaded on the official website of this Tribunal. Thereafter, file be consigned to record room.
