Appeal No.02/2020 KMB Vs. M/s KJ International

22.12.2020 Item No.2

Present: Adv. Usha Singh, Counsel for the appellant.

This appeal has been filed by the appellant Kotak Mahindra Bank against the order of Recovery Officer order dated 22.10.2020 which is annexure A-13 at page no. 60-A. Counsel for the appellant has stated that Recovery Officer has given long date 26.02.2020 and this appeal has been filed against this order dated 22.10.2020.

I have perused order dated 22.10.2020 and in this order Recovery Officer has adjourned the case to 26.02.2020, whether this order is appealable or not, counsel for appellant has not replied to this question. Recovery Officer has given only date and has not passed any order on merits. Therefore, the order dated 22.10.2020 is not appealable and appellant bank can move an application before Recovery Officer to get this matter preponed as per law. Accordingly, since order dated 22.10.2020 is not appealable and this appeal is dismissed.

File be consigned to record room.
