MA No.8/14 HPFC Vs M/s Gagret Woolen Mills (P) Ltd & Ors.

20.05.2019 Item No.35 Present: None for the applicant FI

Despite calling the matter number of times none appeared for the applicant FI. There is no request either for pass over or for adjournment even after 3rd pass over. Perusal of record shows that service report has not been filed by the applicant FI despite issuing notice twice on 19.03.2014 & 15.04.2015 even after lapse of five years and none is appearing on behalf of applicant FI from the last three consecutive dates also. Waited sufficiently. It appears that the applicant FI is not interested to pursue the matter. Since none is present on behalf of the applicant FI to press upon this application it appears that applicant has lost interest in this case, hence case is dismissed for non-prosecution on the part of the applicant FI. Let copy of this order be given dasti to the applicant FI and thereafter file be consigned to record.
