MA No.47/18 In OA No.596/17 PSB Vs Swaran Singh & Anr.

22.05.2019 Item No.53 Present: None for the applicant/defendant no.2 Shri Dipinder Singh, counsel for the respondent/applicant OA bank Despite calling the matter number of times none appeared for the applicant/defendant no.2. There is no request either for pass over or for adjournment even after 3rd pass over. The counsel for the respondent/applicant OA bank has stated that paper book has not yet been supplied and today also none appeared on behalf of applicant/defendant no.2 to supply the paper book. Waited sufficiently. It appears that the applicant/defendant no.2 is not interested to pursue the matter. Since none is present on behalf of the applicant/defendant no.2 to press upon this application it appears that applicant/defendant no.2 has lost interest in this case, hence case is dismissed for non-prosecution on the part of the applicant/defendant no.2. Let copy of this order be given dasti to the respondent bank and through registered post to the applicant and thereafter file be consigned to record.

(Harcharn Singh), Presiding Officer,

DRT-I, Chandigarh Rajinder 22.05.2019
