DEBTS RECOVERY TRIBUNAL-I CHANDIGARH

MA 62 of 2019 in OA 694 of 2019

Bank of India

Vs. Santosh Jutti Mfg. & Embroidery House & Anr.

08.08.2019

Item No.37

Advocate: Sh. Raghav Kakkar, Counsel for the Applicant.

This Application has been filed by the Applicant for recalling/modification of order dt.05.07.2019 whereby the OA was dismissed in default for non compliance of order.

The Counsel for the applicant has argued that the Bank has duly complied with the orders and the defendants had been served on 08.06.2019 but since the clerk of the Counsel had noted date of hearing as 15th July, 2019 in his diary instead of 5th July, 2019, the same could not be placed on record and prayed that the order dt.05.07.2019 be recalled and service report be taken on record.

I have heard counsel for the Applicant Bank.

Since the counsel for the Applicant has filed service report, the order dt.05.07.2019 is hereby recalled. The MA is allowed.

OA is restored.

MA file be consigned to record. (Harcharn Singh), Presiding Officer, DRT-I, Chandigarh 08.08.2019/cms
