MA No.77/19 In OA No.341/19 PNB Vs Gurmukh Singh

28.08.2019 Item No.11 Present: Shri N K Mankotia, counsel for the applicant bank This Misc. Application has been filed by the applicant bank for recalling order dated 17.05.2019 and rectifying typing mistakes apparent on the face of record under Section 19 (25) of RDDBFI Act 1993 read with Section 151 CPC. Since the defendants are exparte in this case, no purpose will be solved by issuing notice. I have heard the counsel for the applicant bank and perused the record. The counsel for the applicant prays for rectifying the typing mistakes stating that: Page 1, the para 1 line reads “the applicant bank filed this OA for recovery of a total sum of Rs.3,27,693.62p (Three Lakh Twenty Seven Thousand Six Hundred Ninety Three point sixty two) which is factual incorrect. The amount of OA should be “Rs.32,76,09362p( Rupees Thirty two lakh seventy six thousand, ninety three point sixty two). Application is allowed being mistake apparent on the face of record and inadvertent typing error. Accordingly, in Judgment and Recovery Certificate the amount be read as “Rs.32,76,093.62p (Rupees Thirty two lakh seventy six thousand, ninety three point sixty two) instead of Rs.3,27,693.62p (Three Lakh Twenty Seven Thousand Six Hundred Ninety Three point sixty two). MA stands disposed off. Let copy of this order be sent to the learned Recovery officer for further action. Copy of this order be given free of cost to the applicant bank and thereafter file be tagged alongwith OA and consigned to record room.
