DEBTS RECOVERY TRIBUNAL-I CHANDIGARH

**MA 95 of 2019**

*In*

OA 4612 of 2017

State Bank of India vs. Bajwa Trading Co. & Anr.

**20.11.2019**

Item No.4

Present: Sh. Umang Khosla, Counsel for the Applicant Bank.

This Application has been filed for amendment/correction in the amount of claim mentioned in the Recovery Certificate.

The Counsel for the Bank prayed that instead of Rs.13,84,559.89p @13.75% p.a. with half yearly rests the decreed amount should have been Rs.41,38,012/- @13.75% p.a. with monthly rests which the Bank has claimed in its OA.

I have heard counsel for the Bank and perused the record.

It has been found that there is an apparent error on record. The Bank has claimed an amount of Rs.41,38,012/- but @13.15% p.a. with monthly rests and not @13.75% p.a. with monthly rests as mentioned in the present MA.

Therefore, Let correction in the amount and rate of interest mentioned in RC be read as Rs.41,38,012/- @13.15% p.a. with monthly rests instead of Rs.13,84,559.89p @13.75% p.a. with half yearly rests. Necessary correction be also made in the RC accordingly. Further, in the cost column fee on Application filed should be read as Rs.44,000/- instead of Rs.16,000/-.

A copy of this order be sent to the concerned Recovery Officer along with corrected copy of RC.

MA allowed. File be consigned to record.
