DEBTS RECOVERY TRIBUNAL-I CHANDIGARH

MA 100 of 2019 Punjab National Bank Vs. Hill View Distillery & Bottling Plant

18.12.2019

Item No.11

Present: Sh. Virender Sood, Counsel for the Applicant

This Misc. Application has been filed by the Applicant Bank for correction in the amount allowed as Court Fee in the RC issued in OA 1463 of 2019.

The Counsel for the Applicant has stated that the Bank had filed OA for recovery of Rs.3,36,79,974.70p which was decreed in its favour and that while issuing RC Court Fee of Rs.17,000/- has been allowed inadvertantly whereas the Bank had paid court fee of Rs.1.50 lakh. Hence, he prayed for correction in the Court Fee allowed in RC.

I have heard counsel for the Applicant and perused the record.

The mistake being apparent on record, let Rs.1,50,000/- amount of court fee should be considered to have been awarded instead of Rs.17,000/- in RC dt.21.11.2019 issued in OA 1463 of 2019.

A copy of this order along with corrected RC amount should be sent to the concerned RO for necessary action at his end.

MA allowed. File be consigned to record.
