This MA is filed by the applicant as the SA was disposed of with the direction to hand over the possession to the applicant on the date when 25% of the amount is deposited.

There were no directions given to the counsel for the applicant to make the payment by himself in case of default. This is a self imposed interpretation which is not correct, since he has undertaken that his client will make the payment. The Tribunal only directed him to ensure that the payment is made that does not mean, he will make the payment from his own pocket.

Now Court Commissioner Shri Bhagwan Singh Dhaked, having phone no. 9887720476, advocate is being appointed on fee of Rs. 20,000/- to be paid by applicant for take back the possession from the respondent and hand it back to the applicant. The applicant has to release the fees of the court commissioner within one week of submission of report. Court Commissioner is directed to visit the property immediately after deposit of amount to the respondent FI. The Police Authorities of the concerned area are hereby ordered to provide police protection if required to the Court Commissioner.
