1. In this matter, the applicant is trying to make a new case, shifting the entire blame to the respondent as if they have done some criminal act by advancing the loan to the borrowers.

2. They are commercial institution, doing a financial service to the nation by granting loan to the borrowers who are in the need of the money to help the society to grow by their businesses.

3. The order which is being referred to 24.03.2026 which was a consented order. The bank on 16.04.2026 has already given a letter calculating the entire due amount as on date, i.e. 16.04.2026 as Rs. 1,00,67,401/- According to the bank there was a condition that 15% of the amount has to be paid within 15 days of the order.

4. Admittedly, Rs. 5.00 Lac was paid which is 5% of the amount, according to the respondent the said order was operating only if 15% of the amount was paid.

5. Much water has flown, if the borrower makes an effort by obtaining the consented order and ditching the securitization proceedings, it cannot appreciated. Entire blame is being made to the bank that they are moving ahead, saying that they were ready to pay Rs. 58.00 Lac as on 03.09.2026 when the possession was taken. It is a simple math 13% interest Court of the Presiding Officer cm has to be paid on the demand notice amount which is Rs. 68,78,653/- Every month interest comes to approximately Rs. 73,857/-.

6. Only Rs. 5.00 Lac has been paid, Respondent is still ready and willing to accept this amount as per that order but the applicant is not ready to pay. Therefore, Bank is at liberty to proceed ahead.

7. Counsel for the applicant is submitting that he has prepared the DD of another Rs. 10.00 Lac approximately which would have made at 15%, but ironically, after having obtain the consent order and having undertaken it, he has given the letter to the respondent to settle this account at Rs. 57.00 Lac. This conduct is not acceptable.

8. In view of the above, this MA stands dismissed, all pending IAs also stands disposed off, if any.

9. File be consigned to record as per rules. Copy of order be uploaded on website.
