HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR

Order

09/09/2026

1. The petitioners have filed these bail applications under Section 483 of BNSS in FIR No.341/2025 registered at Police Station Baseri, District Dholpur for offence under Sections 115(2), 126(2), 189(2) and 103(1) of BNS, 2023.

2. Since all these bail applications arise out of same FIR, hence, they are being decided by this common order.

3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and counsel for the complainant and perused the material available on record.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in these cases. They further submit that though the petitioners have been named in the FIR, as per the post-mortem report of deceased Aman, apart from one gunshot injury, no external injury was inflicted upon the deceased. He further submits that the statements of the eyewitnesses, Vidhya Devi, Pushpendra and Ashish, have been recorded under Section 180 of the BNSS, which reveal that the principal assailant was Vijay Thakur, who fired at the deceased Aman, resulting in his death. He contends that the principal assailant has already been enlarged on bail by the trial Court itself on 11.08.2026. He argues that there was no active contribution of the petitioners in the murder of the deceased. Petitioners are behind the bars since 09.10.2025 respectively though one case has been reported against the petitioner-Vishnu and five cases have been reported against the petitioner-Ankit, however, in these

(3 of 3) [CRLMB-3443/2026] cases, he is already on bail. The trial of the case will take considerable time and no further custodial interrogation is required, hence the bail application of the petitioners may be allowed.

5. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application.

6. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

7. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Praveen @ Panni S/o Sugar Singh, Vishnu S/o Kanhaiya, and Ankit @ Lukka Son Of Shri Rajan Singh,, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
