Order

09/09/2026

1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.210/2026 registered at Police Station RLY Colony, District Kota City for offences under Sections 69, 115(2) and 126(2) of BNS, 2023.

2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

3. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in this case. He submits that both the parties are admittedly major having the age of 24 years and matter is consensual in nature which reflects from the earlier FIR lodged by the victim against the petitioner on 14.07.2026 in which she levelled allegation against the present petitioner for

(2 of 3) [CRLMB-12924/2026] beating her and stated that she was living with the petitioner from last one and half years. It is further submitted that, in the affidavit filed in the earlier proceedings, the petitioner had specifically mentioned that the victim and the petitioner had been living together for the last two years and that owing to an emotional state of mind, the victim had lodged the FIR against him on false and concocted grounds. He further submits that the contents of the affidavit filed in the earlier proceedings arising out of the previous FIR demonstrate that the present FIR has been lodged on false and concocted grounds. He argues that, in her statements recorded during the course of investigation under Section 183 BNSS, the victim has stated that she and petitioner were in a love affair and were living together as husband and wife. Petitioner is behind the bars since 02.08.2026 without any criminal past. Charge-sheet has been filed, the trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed.

4. Learned Public Prosecutor has vehemently opposed the bail application.

5. On consideration of the rival submissions and the material available on record, and in the light of the submissions made by the learned counsel for the petitioner, as well as the affidavit filed in the previous proceedings and the statement of the victim recorded under Section 183 of the BNSS but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
