1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.4/2026 registered at Police Station Nahargarh (Baran), District Baran for offences under Sections 189(2), 115(2), 126(2) and 103(1) of BNS, 2023.

2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

3. Learned counsel for the petitioners contends that the petitioners have falsely been implicated in this case. He submits that in the present matter, the FIR was lodged by the complainant-Ramkuwar. However, as per his statement recorded

(2 of 3) [CRLMB-7389/2026] during the course of investigation, he has specifically stated that the principal injuries were inflicted by co-accused Bhojraj and Udham, who caused injuries to Radheyshyam, resulting in his death. He further submits that as per the testimony of the complainant, Satyanarain was also an eye-witness to the incident; however, Satyanarain has also narrated the same version as stated by the complainant. He further contends that as per the material available on record, there is nothing to establish any active or passive role of the petitioners at the time of the alleged incident. Rather, it is apparent that the petitioners joined the incident only after the deceased-Radheyshyam, had already sustained injuries at the hands of Bhojraj and Udham. The petitioners did not inflict any injury upon the deceased Radheyshyam, and none of the injuries sustained by the deceased has been attributed to the petitioners. Petitioners are behind the bars since 12.01.2026 though one case has been reported against petitioner- Hemraj and two cases have been reported against petitioner-Chandramohan respectively, however, in all cases, they are already on bail. Charge-sheet has already been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, consequently, the bail application deserves to be allowed.

4. Learned Public Prosecutor has vehemently opposed the bail application.

5. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioners but without expressing any opinion on

(3 of 3) [CRLMB-7389/2026] merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.

6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioners Hemraj S/o Mangilal and Chandramohan S/o Mangilal, be released on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
