Order
03/09/2026
1. This criminal misc. bail application has been filed by the petitioner Raees S/o Abdul Qayyum, under Section 483 of B.N.S.S., 2023, who was arrested by the Police in connection with the FIR bearing No.105/2026 dated 18.07.2026 registered at Police Station Purani Tonk, District Tonk for the offences punishable under Sections 303(2) of B.N.S., 2023 and 4/21 of the Mines and Minerals (Development and Regulation) Act, 1957.
2. Learned counsel submits that the petitioner has falsely been implicated in the present case and the Police has completed the investigation and no recovery is required to be made from him. Learned counsel submits that only two cases of similar nature are pending against him. He further informed that the petitioner has deposited the compound fee and this fact has been recorded by the learned Trial Court in its order dated 24.07.2026. In view
(2 of 3) [CRLMB-12152/2026] thereof, learned counsel prays that the petitioner be enlarged on bail.
3. Learned Public Prosecutor strongly opposes the bail application, however, could not refute the contention by submitting that the petitioner has already deposited the compounding fee, police has completed the investigation and no recovery is required to be made from him.
4. Heard learned counsel for the parties and perused the contents of the FIR as well as charge-sheet
5. This Court, after considering the nature of allegations, investigation is complete, trial will take sufficiently long time, petitioner has already deposited the compound fee, and without commenting upon merits of the case, is inclined to exercise its powers under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Raees S/o Abdul Qayyum shall be released on bail, provided he executes a personal bond in a sum of ₹1,00,000/- each with two sound and solvent sureties of ₹50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
(3 of 3) [CRLMB-12152/2026]
7. It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail. (RAVI CHIRANIA),J 131/Monika
