1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.606/2025 registered at Police Station Kotwali Jhalawar, District Jhalawar for offences under Sections 111(3), 111(4), 111(5), 111(6), 318(4), 316(2), 338, 336(3), 340(2), 308(6) of BNS, 2023 and Section 6(1)(b) of Officials Secret Act, 1923.

2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.

3. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He submits that though the petitioner has been named in the FIR but the main culprit namely Hemraj has already been enlarged on bail by a Co-ordinate Bench of this Court vide order dated 04.12.2025 along with other co-

(2 of 3) [CRLMB-12166/2026] accused Sunil, Pramod, Murarilal, Mahesh Kumar, Purushottam, Sohel Khan, Mohammed Farukh Khan, Sitaram and Kalu. It is further submitted that other co-accused Jyoti, Seema, Riyaz and Yogendra Singh have also been granted the benefit of bail by a Co-ordinate Bench of this Court vide order dated 19.12.2025. Co- accused Aman and Tosif have been enlarged on bail by the learned Trial Court itself. He further submits that the present petitioner has been implicated in the present case only on the basis of call detail records and there is no other substantive material connecting him with the alleged offence. The case of the present petitioner is on better footing. Petitioner is behind the bars since 18.07.2025 though five criminal cases have been reported against him, however, in all the cases he is already on bail. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and on the ground of parity with other co-accused, the bail application of the petitioner may be allowed.

4. Learned Public Prosecutor has vehemently opposed the bail application.

5. On consideration of the rival submissions and material available on record and in light of submission made on behalf of petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Maksood Khan S/o Shri Mahmood Khan, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the
