1. The instant petition has been preferred against the order dated 23.04.2026 passed by the Jaipur Development Authority (for short 'JDA'), by which notice under Section 32 of the Jaipur Development Authority Act, 1982 (for short, 'the Act of 1982') has been issued to the petitioner and the subject premises of the petitioner has been seized.

[2026:RJ-JP:35095] (2 of 2) [CW-11513/2026]

3. Without filing an appeal under the aforesaid provision before the statutory Appellate Authority, the petitioner has straightaway approached this Court by way of filing the instant petition.

4. It is settled proposition of law that whenever alternative statutory remedy of filing an appeal is available to a person, he cannot be allowed to bypass the jurisdiction of the said authority.

5. On this count alone, the instant writ petition stands disposed of with liberty to the petitioner to file an appeal under Section 83(8) of the Act of 1983 before the Appellate Authority, JDA.

6. In case, any appeal is preferred by the petitioner before the Appellate Authority within a period of two weeks from the date of receipt of certified copy of this order, it is expected from the Appellate Authority to decide the said appeal expeditiously, as early as possible, strictly in accordance with law, ignoring the period of limitation.

7. The stay application and all pending applications, if any, also stand disposed of. (ANOOP KUMAR DHAND),J KuD/30
