This criminal appeal under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellants being aggrieved with the order dated 14.08.2026 passed by the learned Special Judge S.C./S.T. (Prevention of Atrocities Cases), Jhalawar (hereinafter to be referred as ‘trial court’) in FIR No. 0097/2026 registered at Police

(2 of 3) [CRLAS-1939/2026] Station Jawar, District Jhalawar for the offence under Sections 329(3) and 126(2) of BNS, 2023 and Sections 3(1)(f) and 3(1)(g) of SC/ST Act whereby the trial court has dismissed the bail application filed on behalf of the appellants.

2. Heard the learned counsel for the appellants as well as learned Public Prosecutor and perused the material on record.

3. Learned counsel for the appellants submits that the appellants have been falsely implicated in this case. He further submits that the allegation against the appellants is that they committed criminal trespass upon the land of the complainant by raising illegal construction thereon. The appellants are in custody since since 13.08.2026. No further custodial interrogation of the appellants is required. One of the appellants, namely, Govind Carpenter is an Army personnel. Therefore, the appeal presented by the present appellants may be allowed.

4. Despite intimation, no one has put in appearance for the complainant.

5. Learned Public Prosecutor has vehemently opposed the appeal.

6. Considering the facts and circumstances of the case and without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the appeal filed by the appellants under Section 14-A of SC/ST Act.

7. Accordingly, this criminal appeal filed under Section 14-A of SC/ST Act is allowed and order dated 14.08.2026 passed by the learned trial court is set aside. It is directed that appellants-
