Order
31/08/2026
1. This criminal misc. bail application has been filed by the petitioner Omprakash Keer S/o Chauthmal, under Section 483 of B.N.S.S., 2023, who was arrested by the Police in connection with the FIR bearing No.208/2026 dated 03.06.2026 registered at Police Station Baroni, District Tonk for the offences punishable under Sections 305(e) of B.N.S., 2023 and 4/21 of the Mines and Minerals (Development and Regulation) Act, 1957.
2. Learned counsel submits that the petitioner has falsely been implicated in the present case and the Police, after completing the investigation, has filed the charge-sheet. He further informed that the petitioner has also deposited the compound fee of Rs.1,00,000/- on 30.06.2026 and trial of the case will take sufficiently long time. In view thereof, learned counsel prays that the petitioner be enlarged on bail.
[2026:RJ-JP:34914] (2 of 2) [CRLMB-11810/2026]
3. Learned Public Prosecutor strongly opposes the bail application, however, could not refute the contention by submitting that there are no criminal antecedents of any nature in the past against the accused-petitioner.
4. Heard learned counsel for the parties and perused the contents of the FIR as well as charge-sheet
5. This Court, after considering the fact that the charge-sheet has already been filed, trial will take sufficiently long time, petitioner has already deposited the compound fee, and without commenting upon merits of the case, is inclined to exercise its powers under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Omprakash Keer S/o Chauthmal shall be released on bail, provided he executes a personal bond in a sum of ₹1,00,000/- each with two sound and solvent sureties of ₹50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
7. It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail. (RAVI CHIRANIA),J 84/Monika
