Order

31/08/2026

1. Learned counsel for the petitioner submits that petitioner has filed this writ petition against order dated 17.04.2026 passed by the Director, State Insurance and Provident Fund Department, Rajasthan, Jaipur, whereby after getting convicted in a criminal case arising out of the provisions of Prevention of Corruption (Amendment) Act, 2018 the petitioner has been dismissed from service in exercise of powers under Rule 19 of the Rajasthan Civil Services (CCA) Rules, 1958 (hereinafter to be referred as 'the Rules of 1958').

2. It is not disputed that the order dated 17.04.2026 is appeallable under Rule 23 of the Rules of 1958, however, no plausible reasons have been mentioned in the memo of writ

[2026:RJ-JP:34878] (2 of 2) [CW-12278/2026] petition for not approaching the Appellate Authority. In view of above, where there is availability of alternative efficacious remedy, this Court does not find any ground to interfere in this writ petition, and the same is hereby dismissed.

3. It is made clear that mere dismissal of this writ petition would not curtail the rights of the petitioner to approach the Appellate Authority and in case, the appeal is filed by the petitioner it should be decided strictly in accordance with law.

4. Pending application(s), if any, also stand(s) disposed of. (ANAND SHARMA),J 27/DIVYA
