Judgment

25/08/2026

1. Learned counsel for the petitioner submits that the present matter pertains to the RAC Recruitment-2010. It is submitted that the petitioner was denied appointment on the basis of certain unsubstantiated criminal allegations.

2. It is next submitted that the petitioner faced a prolonged criminal trial for almost 12 years and was acquitted of all charges vide judgment dated 05.02.2026 passed in Case No. 718/2024

(2 of 3) [CW-16497/2026] (CIS No. 12059/2014) titled State of Rajasthan Vs. Hari Singh.

3. It is further submitted that following the said acquittal, the petitioner submitted a representation before the respondent- authorities seeking the restoration of his candidature and subsequent appointment with all consequential service benefits. However, the respondents rejected claim of the petitioner on the premise that the acquittal had taken place beyond the prescribed period of three years.

4. Learned counsel contends that the impugned action of the respondents is arbitrary and in gross violation of Articles 14 and 16 of the Constitution of India. It is argued that the petitioner is being unfairly denied appointment solely on account of the time consumed in the criminal proceedings, a circumstance which was wholly beyond the control of the petitioner, and therefore, the petitioner is seeking revival of his vested rights in pursuance of the 2010 recruitment.

5. It is also pointed out by the learned counsel that certain subsequent developments have taken place since the recruitment of 2010.

6. Heard the submissions advanced by learned counsel for the petitioner.

7. Considering the factual matrix of the case at hand, it is an admitted fact that no vacancy exists qua the post in question as on date pertaining to the RAC Recruitment-2010. In view of the said undisputed position, this Court is not inclined to interfere in

(3 of 3) [CW-16497/2026] the present petition to the extent of issuing a mandamus for appointment.

8. However, taking a holistic view of the matter, the liberty is granted to the petitioner to file a fresh and detailed representation before the competent authority of the respondents within a period of seven working days from the date of receipt of certified copy of this order.

9. Upon receipt of such representation, the competent authority of the respondents is directed to consider and decide the same strictly in accordance with law within a period of thirty days, thereafter.

10. Accordingly, with the aforesaid liberty and directions, the present writ petition stands disposed of. Pending application(s), if any, shall also stand disposed of. (SAMEER JAIN),J 40/DIVYA
