1. In the present writ petition, the petitioners pray as under: "It is, therefore, humbly prayed that this Hon'ble Court may kindly accept and allow this writ petition and be further pleased to:

(i) Issue an appropriate writ, order or direction quashing and setting aside the action of the respondents in constructing and inaugurating the RSRTC Halt Bus Stand over land comprised in Khasra No. 2707, admeasuring 2.86 hectares, situated at Village Kama, Tehsil Kama, District Deeg, to the extent of 0.80 hectares (40/143 share), being illegal, arbitrary and unconstitutional.

(ii) Issue an appropriate writ, order or direction directing the respondents to remove/demolish the illegal construction of the RSRTC Halt Bus Stand raised over the aforesaid land and restore the land to its original condition.

(iii) In the alternative, direct the respondents to shift the proposed/constructed bus stand to any other suitable Government land available in Village Kaman or nearby area without disturbing the petitioners' religious, customary and charitable activities relating to the Brij Chaurasi Kos Parikrama.

(iv) Issue an appropriate writ, order or direction restraining the respondents, their officers, employees, agents or any person acting under their authority from making any further construction, alteration, expansion, allotment or creating any third-party rights over the disputed land.

(v) Direct the respondents to maintain and preserve the land earmarked for Brij Chaurasi Kos Yatra and not to interfere with the petitioners' longstanding religious, charitable and public service activities conducted thereon except in accordance with law.

(vi) Any other writ, order or direction which this Hon'ble Court may deem just and proper in the facts and circumstances of the case may also be passed in favour of the petitioners."

2. This Court notices that the petitioners have unnecessarily impleaded the present Chief Minister by name as respondent No.6 and made a bald allegation of allotting the land of Khasra No.2707 admeasuring 2.86 hectares for roadways bus stand.

3. Learned counsel for the petitioners submits that the land was originally recorded in the name of the father of petitioner No.1 and could not have been allotted.

(3 of 3) [CW-16500/2026]

4. Disputes regarding title on revenue land lie before the Revenue Courts. This Court notices that already a RSRTC halt bus stand is established on the land bearing Khasra No.2707 and claim of the petitioners to remove the said bus stand is based on their claim of title, which is yet to be established.

5. The allegations against respondent No.6 are also found to be, prima facie, concocted and without basis.

6. The writ petition filed by the petitioners is found to be without any basis or documentary proof regarding claim of title over the land in dispute. Mere bald assertion cannot be accepted.

7. The writ petition is found to be wholly frivolous and the same is accordingly, dismissed.

8. All pending applications also stand disposed of. (SANJEEV PRAKASH SHARMA),ACTING CJ 22/Gaurav
