Order

24/08/2026

1. Issue notice to the respondents.

2. Mr. Devansh Sharma, learned Dy.GC accepts notice on behalf of all the respondents.

3. Hence, service is complete.

4. The present writ petition has been filed with the following prayers :- "It is, therefore, most respectfully prayed that your lordship may graciously be pleased to accept and allow the writ petition and by an appropriate writ of mandamus, order or direction in nature thereof: i) The respondents may kindly be directed to sanction the C.C.L. of the petitioner for period from 08.08.2026 to

(2 of 3) [CW-16477/2026] 07.11.2026 (90 days) with all consequential service benefits. ii) Any other order which this Hon'ble Court may deems fit and proper in the facts and circumstances of the case also be passed in favour of humble petitioner along with cost of writ petition."

5. Mr. Bhagchand Bairwa, learned counsel for the petitioner submits that despite submitting an application before the competent authority seeking child care leave for a period of 90 days, no decision has been taken by the respondents on the said application and thus, he has limited his prayer to direct the respondents to take an objective decision on the application made by the petitioner in an expeditious manner.

6. Mr. Devansh Sharma, learned Dy.GC for the respondents submits that the application so submitted by the petitioner would be duly considered in accordance with the applicable rules and regulations in a time-bound manner.

7. Taking note of the aforesaid submissions and without delving into the merits/demerits of the matter, the present writ petition is disposed of directing the respondents to objectively consider and decide the application seeking child care leave so submitted by the petitioner by passing a speaking and reasoned order within a period of 15 days from today, i.e. 24.08.2026, strictly in accordance with law. The respondents are also directed to duly communicate the decision so taken to the petitioner, along with a copy of the same.

8. Pending application(s), if any, stands disposed of.

9. Needless to say, this order has been passed only to decide the petitioner's application strictly in accordance with law and in

(3 of 3) [CW-16477/2026] no manner is to be construed as a direction to decide the same in a particular manner.

10. However, the petitioner would be at liberty to invoke any other remedy as she deems fit and proper for redressal of her grievance in accordance with law, if so advised. (ANUROOP SINGHI),J 21/VINAY
