Order

24/08/2026

1. The present bail application has been filed on behalf of the accused-applicant under Section 483 of the B.N.S.S, 2023 against the order dated 30.07.2026 passed by learned Additional District & Sessions Judge Atru, District Baran (Raj.) in Criminal Case No. 122/2026 arising out of FIR No. 145/2026, registered at Police Station Atru, District Baran for the offences punishable under Sections 115(2), 126(2), 110 & 189(2) of BNS, 2023, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 was dismissed.

2. Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter. Learned counsel argues that in this case, charge-sheet against the

Learned counsel also argues that though the charge-sheet for the offences punishable under Section 109(1) of BNS, 2023 has also been submitted, but none of the injuries sustained by the injured persons, namely, Pankaj, Dhanraj & Kuldeep, has been found to be dangerous to life. Learned counsel contends that the allegation against the accused-applicant is that he caused a sharp-edged injury on the head of injured Dhanraj, but subsequently, the injury has been found to be simple in nature. Learned counsel further contends that other co-accused persons, namely, Saurabh and Pratik have also been granted bail by a Co-ordinate Bench of this Court. Learned counsel also submits that the accused-applicant was arrested on 28.07.2026 and since then, he is behind the bars and is 58 years old. Learned counsel prays that the trial will take a long time to conclude; therefore, the accused-applicant be enlarged on bail.

3. On the other hand, learned Deputy Government Advocate opposes the bail application.

4. Heard learned counsel for the parties and also perused the material available on record.

5. Having regard to the facts and circumstances of the case and considering the facts that the accused-applicant is behind the bars since 28.07.2026; that none of the injuries has been found to be dangerous to life; that the charge-sheet has been filed and the trial will take a long time to conclude, without expressing any

6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Giriraj Prasad Malav Son of Bhairulal, arrested in FIR No. 145/2026, registered at Police Station Atru, District Baran shall be released on bail; provided he furnishes personal bond in the sum of Rs.50,000/- and two solvent sureties of Rs.25,000/- each to the satisfaction of the learned trial Court.

7. The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so. (ASHUTOSH KUMAR),J 133/Mohita
