Order

24/08/2026

1. Learned counsel for the petitioner has submitted that the order impugned dated 11.08.2026 marked as annexure-5, is bad in law as well as on facts. It is submitted that the learned Tribunal has wrongly noted that petitioner was transferred from ITI, Kekri, Ajmer to ITI, Masuda, Beawar, whereas in realistic terms, as per the contents reflected at page no. -28 serial no.46, the petitioner was transferred from ITI, Masuda, Beawar to ITI, Gudhamalani i.e. approximately 500 kms away. It is submitted that petitioner was transferred within a period of five months and he shall retire in next 2.5 years.

2. Considering the facts of the case, this Court gives liberty to the petitioner to file representation to the competent authority, which shall be filed and decided in view of the ratio encapsulated in SBCWP No. 14009/2026 titled Dr. Mahesh Meena v. State of Rajasthan and Ors.

3. This Court also directs that the impugned transfer order dated 10.07.2026, shall remain stayed for a period of 30 days, qua the petitioner; and the representation, if any, filed by the petitioner to be adjudicated within the said time.

4. Accordingly, the present writ petition is disposed of. No prejudice be caused to the petitioner, on passing of the order dated 11.08.2026.

5. Pending applications, if any, shall stand disposed. (SAMEER JAIN),J 46/DEEPAK
