1. A B.SC. Nursing Part-IV Examination candidate, i.e., the petitioner has failed to clear the examination. As per the University Ordinance 299-V-10, the prescribed maximum period to complete the course successfully could not exceed eight years. It also provides that the maximum number of attempts permitted for each paper would be three (including the first attempt).

2. Learned counsel for the petitioner submits that petitioner had cleared all subjects in Part-I to III and one paper of Part-IV

[2026:RJ-JP:34318] (2 of 2) [CW-16840/2026] could not be cleared and the University disallowed the petitioner from participating in the examination.

3. Learned counsel for the petitioner has relied on judgment passed by a Co-ordinate Bench of this Court in the case of Ms. Seema Pargi vs State of Rajasthan and Ors.: S.B. Civil Writ Petition No.16788/2022 decided on 16.04.2026. However, I notice that in D.B. Special Appeal Writ No.1188/2022: Yogendra vs Rajasthan University of Health Sciences and Ors. (decided on 11.11.2022), a Division Bench of this Court has held otherwise.

4. In view thereto, I am bound by the judgment passed by the Division Bench. No case for granting more chances for clearing B.SC. Nursing Course can be given by the Court as the University Ordinance cannot be changed by this Court while exercising power under Article 226 of the Constitution of India.

5. In view of above, the civil writ petition is dismissed.

6. All pending application also stand disposed of.
