Order

24/08/2026 The instant 2nd bail application has been filed by the petitioner, arrested in connection with FIR No.306/2023, Police Station Sri Madhavpur, District Sikar for the offence under Sections 307 & 458 of IPC, 1860 and Sections 3, 25 & 27 of Arms Act, 1959.. The petitioner has filed second bail application after the first one was dismissed as withdrawn by order dated 18.12.2025, while granting the liberty to file a fresh bail application in the change of circumstances. Now, he has filed the second bail application as statements of certain witnesses have been recorded. This Court also considered the statements of prosecution witnesses as recorded by the learned trial Court which are PW.1 to PW.7.

[2026:RJ-JP:34368] (2 of 2) [CRLMB-6954/2026] Apart from the aforesaid, this Court also considered the serious criminal antecedents of the petitioner. As per the order of the trial Court there are as many as 21 criminal cases against the petitioner, commencing from year 2009 continuing up to the year 2024. It is also noted that petitioner is behind the bars from last more than one and a half years. It is further noted that out of the total number of criminal antecedents as reported against the petitioner, some are of 307 of IPC. Learned counsel for the petitioner submits that out of 21 cases he has been acquitted in 8 cases and is on bail in other matters. Learned Public Prosecutor has opposed the bail application. This Court also considered the objection as raised by the learned Public Prosecutor and noted that the criminal antecedents of the petitioner which are of serious nature does not warrant this Court to exercise its powers to enlarge the petitioner on bail. After considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Consequently, the 2nd bail application is dismissed. Pending application(s), if any, stand(s) disposed of. (RAVI CHIRANIA),J 4/ANIL
