1. The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 09.07.2026 passed by learned Additional District and Sessions Judge, Brij Nagar, District Deeg, in Criminal Misc. Case (CIS) No.392/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No.246/2014, Police Station Brij Nagar, District Bharatpur for the offences under Section 336, 332, 353, 307 of the IPC, and Section 3 of the Prevention of Damage to Public Property Act, 1984, Secton 3, 5/8 of the Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act, 1995 and Section 11(D)26 of Prohibition to Animal Cruelty Act and under Section 3/25 Arms Act, under Section 184 Motor Vehicle Act.

2. Learned counsel for the petitioner submits that the petitioner has been in custody since 17.06.2026. He further submits that

(2 of 3) [CRLMB-11493/2026] there were two cases of the same nature registered under the State Act of Haryana against the petitioner earlier. He further submits that the challan in the present case has already been filed under Section 299 Cr.P.C., and thereafter, a supplementary charge-sheet has also been filed.

3. Learned counsel for the petitioner submits that the petitioner is a resident of Haryana and that the two cases pending against him are also registered in the State of Haryana, in which he had been regularly attending the proceedings. Therefore, there was no likelihood of the petitioner absconding. He submits that, without apprehending the petitioner, the charge-sheet under Section 299 Cr.P.C. has been filed.

4. Learned counsel for the petitioner also submits that the conclusion of trial will take sufficiently long time and even the offences are triable by the Magistrate. Learned counsel also submits that the co-accused namely Sahun has already been enlarged on bail after remaining in custody less then one and half months by Co-ordinate bench of this Court vide order dated 16.04.2021 in S.B. Criminal Miscellaneous Bail Application No. 5345/2021 and the case of the petitioner is on no lessor footing then that of the co-accused Sahun. He further submits other co- accused have also been enlarged on bail by different orders, and therefore, he prays that the petitioner may also be enlarged on bail.

5. Learned Public Prosecutor vehemently opposes the bail application.

6. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.

(3 of 3) [CRLMB-11493/2026]

7. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, and particularly the fact that co-accused Sahun has already been enlarged on bail; other co-accused have also been enlarge on bail; trial is likely to take a considerable time; supplementary charge-sheet has also been filed, this Court is of the opinion that the bail application deserves to be accepted.

7. Consequently, the bail application is allowed. It is ordered that the accused-petitioner - Khurshid @ Fauji Son Of Akbar arrested in connection with F.I.R. No. 246/2014, Police Station Brij Nagar, District Bharatpur, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/- (Rs.
