Order

21/08/2026 The present bail application has been preferred by the petitioner under Section 483 of BNSS (Old Section 439 Cr.P.C.) in connection with FIR No.381/2022 registered at Police Station Udaipurwati, District Jhunjhunu for the offences punishable under Section 420, 467, 468, 471 & 120B IPC.

2. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

3. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the matter. It is further submitted that co-accused Mohani Devi W/o Banwari and Phuli Devi W/o Late Boduram have already been enlarged on bail by this Court while deciding S.B. Criminal Misc. Bail Application No.6278/2026 vide order dated 19.08.2026. Learned counsel

[2026:RJ-JP:33974] (2 of 2) [CRLMB-13430/2026] submitted that the petitioner is in judicial custody and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioner.

4. Per contra, learned Public Prosecutor has vehemently opposed the bail application.

5. Having considered the rival submissions, facts and circumstances of the case, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioner on bail.

6. Consequently, the bail application under Section 483 of BNSS (Old Section 439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner Banwari S/o Late Shri Dhudaram, arrested in connection with FIR No.381/2022 registered at Police Station Udaipurwati, District Jhunjhunu shall be released on bail provided he furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each, to the satisfaction of learned trial Court, for his appearance before that Court on each & every date of hearing and whenever called upon to do so till completion of the trial.
