Order

21/08/2026 The present bail application has been preferred by the petitioner under Section 483 of BNSS (Old Section 439 Cr.P.C.) in connection with FIR No.373/2025 registered at Police Station Sadar Bundi, District Bundi for the offences punishable under Sections 316(2) & 318(4) of BNS.

2. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

3. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the matter. It is further submitted that co-accused Naresh Kumar S/o Rameshwar Lal and Shabir S/o Dinu have already been enlarged on bail by the co-ordinate Bench of this Court vide order dated 27.03.2026. Learned counsel for the petitioner also submitted that the offence

[2026:RJ-JP:33795] (2 of 2) [CRLMB-12378/2026] alleged to have been committed by the petitioner is triable by court of Magistrate. Lastly, learned counsel submitted that the petitioner is in judicial custody and the trial of the case will take sufficiently long time, therefore, the benefit of bail may be granted to the accused-petitioner.

4. Per contra, learned Public Prosecutor has vehemently opposed the bail application.

5. Having considered the rival submissions, facts and circumstances of the case, without expressing any opinion on merits/demerits of the case, this Court is inclined to enlarge the petitioner on bail.

6. Consequently, the bail application under Section 483 of BNSS (Old Section 439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner Nanalal @ Nanuram S/o Shri Lalaram, arrested in connection with FIR No.373/2025 registered at Police Station Sadar Bundi, District Bundi shall be released on bail provided he furnishes a personal bond of Rs.1,00,000/- and two sureties of Rs.50,000/- each, to the satisfaction of learned trial Court, for his appearance before that Court on each & every date of hearing and whenever called upon to do so till completion of the trial.
