Mr. Kailash Chander Sharma, learned counsel for the petitioner submits that as the application seeking voluntary retirement dated 10.06.2026 was withdrawn by the petitioner on 28.07.2026 itself, which was the date prior to his retirement coming into effect, the impugned order whereby the petitioner has been made to retire w.e.f. 31.07.2026, could not have been passed.

3. In support of the aforementioned submission, learned counsel for the petitioner has placed reliance upon the judgment dated 20.03.2025 passed by the Hon'ble Division Bench of this Court in D.B. Civil Writ Petition No.737/2023, titled as Bhikam Chand Vs. The State of Rajasthan and order dated 28.04.2026 passed by a Co-ordinate Bench of this Court at

Civil Writ Petition No.737/2023 and S.B. Civil Writ Petition No.8266/2026, by passing a reasoned and speaking order after affording an opportunity of hearing to the petitioner.
