1. The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 31.07.2026 passed by learned Additional Sessions Judge No. 01, Ajmer, Rajasthan in Criminal Misc. (Bail Application) Case No.851/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No.191/2026, Police Station Civil Lines, District Ajmer for the offences under Section 353(1)(B) of the BNS, 2023 and Sections 66(F) of the Information Technology Act, 2000.

(2 of 3) [CRLMB-12459/2026] was sent from his e-mail ID, stating that “Ajmer would be blown up by a Hindu bomb”. He submits that the petitioner is innocent and is psychologically unfit and is undergoing treatment under the care of a psychiatrist and there are no criminal antecedents against the petitioner of having committed any offence of similar nature or any other nature in past. Moreover, the conclusion of investigation/trial will take sufficiently long time and even the offences are triable by Magistrate, and therefore, he prays that the petitioner may be enlarged on bail.

3. Learned Public Prosecutor vehemently opposes the bail application.

4. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.

5. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, particularly the fact that the petitioner has been under treatment of psychiatrist from 2020 to 2026; the maximum punishment prescribed for the alleged offences is three years; all the offences are triable by a Magistrate; the conclusion of the investigation/trial is likely to take a considerable time; and there are no criminal antecedents against the accused-petitioner of having committed any offence of a similar nature or any other offence in the past, this Court is of the opinion that the bail application deserves to be accepted.

6. Consequently, the bail application is allowed. It is ordered that the accused-petitioner - Phaldu Hardik Rameshchandra S/o Shri Rameshchandra arrested in connection with F.I.R. No. 191/2026, Police Station Civil Lines, District Ajmer, shall be released on bail; provided he furnishes a personal bond of
