Order
20/08/2026
1. Instant civil writ petition under Article 226 of the Constitution of India has been filed by petitioner feeling aggrieved by rejection of his application for issuance of Ward 'IP Certificate' by the concerned authority of the Employees State Insurance Corporation (for short, 'ESIC'). Such certificate is required by petitioner to get benefit of reservation of ESIC College, available in allotment of Colleges for admission in NEET (UG) Courses.
2. It has inter alia been stated that petitioner No.1 has qualified the NEET (UG) Examination 2026 and father of petitioner No.1, who is petitioner No.2, is a member of ESIC Scheme and on that basis, IP Certificate for daughter of petitioner No.2 i.e. petitioner No.1, can be issued by the respondents.
3. When this writ petition came up on Board on 15.07.2026, following order was passed: "1. Counsel for petitioners submits that petitioner No.1 is the daughter of petitioner No.2, and is aggrieved by action/ inaction of respondents in not issuing a Ward of IP Certificate, which is required for her admission to the UG Course (MBBS/BDS) for the Academic Session 2026–27 under the Ward of Insured Person Quota, since her father, petitioner No.2 herein, is an insured person under the ESIC Scheme.
2. Counsel for petitioners further submits that the Ward of IP Certificate has been denied on the technical ground that the name of father of petitioner No.1 is reflected as "Vishram Singh" in certain documents, whereas in others it is mentioned as "Vishram Singh Gurjar". In support of the contention, counsel has placed on record copies of some documents, i.e., CBSE mark sheet, Jan Aadhaar Card, Ration Card and E-Identity Card.
3. Heard.
4. Issue notice of writ petition as also of stay application to respondents.
(3 of 4) [CW-11723/2026] On behalf of respondents No.1 to 3, counsel has put in appearance, accepts notice and undertakes to seek instructions to appear on behalf of respondent No.4 as well. On behalf of respondent No.5 as well, counsel has put in appearance, and accepts notice. For respondent No.6, notices be given to Advocate Mr. M.S. Raghav, Standing Counsel for the National Testing Agency (NTA).
5. Office is directed to reflect names of Mr. Divanshu Gupta, Mr. Pradhuman Singh Rathore and Mr. M.S. Raghav in the cause list as counsel for respondents.
6. As an interim measure, respondents No.1 and 2 are directed to issue a Ward of IP Certificate to petitioner No.1, provisionally, ignoring the discrepancy arising from the addition of the surname "Gurjar" in the name of her father in certain documents.
7. It is made clear that the provisional issuance of the Ward of IP Certificate to petitioner No.1 shall remain subject to final outcome of the present writ petition."
4. Counsel for the petitioners admits and states at bar that in compliance to the order dated 15.07.2026, a provisional Ward of IP Certificate, in favour of petitioner No.1, has been issued by the respondents-ESIC and if in that certificate, either word provisionally is deleted or a fresh certificate is issued, the grievance of the petitioners would be satisfied.
5. Learned counsel appearing on behalf of the respondent Nos. 1 to 3, representing the ESIC, submits that in the light of observations made by this Court in the order dated 15.07.2026, respondents have no objection to issue a Ward IP Certificate in the name of petitioner No.1, who happens to be the daughter of petitioner No.2, since petitioner No.2 is admittedly member of ESIC Scheme.
6. In that view of matter, it is hereby directed that the respondents-ESIC shall delete the word "provisionally" in the Ward IP Certificate, already issued in the name of petitioner No.1, or shall issue a fresh Ward IP Certificate within a period of thirty days from today. The writ petition stands disposed of accordingly.
(4 of 4) [CW-11723/2026]
7. Stay application and pending applications, if any, also stand disposed of. (SUDESH BANSAL),J Pcg/1
