Order

20/08/2026 The present bail application has been preferred by the petitioner under Section 483 of BNSS (Old Section 439 Cr.P.C.) in connection with FIR No.78/2023 of Police Station Kotwali, District Sikar for the offences punishable under Sections 420, 406 & 120-B of the IPC and Sections 4, 5 & 6 of the Prize Chits and Money Circulation Schemes (Banning) Act and Sections 3/21, 5/25 of the Banning of the Unregulated Deposit Schemes Act.

(2 of 3) [CRLMB-3340/2026]

2. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated and there is no specific allegation or overt act showing that he induced the complainant to invest money; the FIR does not disclose any direct meeting or transaction between them and the allegations against the petitioner are vague and omnibus. The ingredients of Sections 420 and 406 IPC are prima facie not made out. The investigation is complete and charge-sheet has already been filed, while nothing incriminating has been recovered from the petitioner except company records. The petitioner has also been granted bail in several other FIRs arising out of identical allegations and involving the same sections and substantially the same role, hence he is entitled to parity. It is further submitted that petitioner is in custody since long and the trial of the case will take long time. Therefore, it is prayed that the accused-petitioner may be enlarged on bail.

4. Learned Public Prosecutor has vehemently opposed the bail application.

5. Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 483 of BNSS (Old Section 439 Cr.P.C.).

6. Accordingly, the bail application filed under Section 483 of BNSS (Old Section 439 Cr.P.C.) is allowed and it is directed that

(3 of 3) [CRLMB-3340/2026] petitioner Ranvir Singh Bijarnia S/o Madan Lal shall be released on bail in connection with FIR No.78/2023 of Police Station Kotwali, District Sikar provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
