20/08/2026 Instant applications for suspension of sentence have been preferred on behalf of the applicant-appellants under Section 430

(2 of 3) [SOSA-1497/2026] of B.N.S.S. alongwith the appeals, to suspend the sentence awarded by the Court of learned Special Judge, NDPS Cases, Karauli (Raj.), vide its judgment dated 19.05.2026 in Special Sessions Case No.30/2022, whereby the applicant-appellants were convicted for the alleged offence(s) & sentenced to undergo maximum period of seven years rigorous imprisonment with fine respectively. Learned counsel appearing on behalf of the applicant– appellants submitted that the appellants remained 25 days in judicial custody during the course of the trial and, presently, they are behind the bars. Counsel further contends that the mandatory provisions have not been complied with and the learned Trial Court has not appreciated the evidence and facts & circumstances of the case holistically and hearing of these appeals will take their own time, hence, the sentences awarded to the applicant-appellants may be suspended during pendency of the appeals. Learned Public Prosecutor has vehemently opposed the submissions made herein-above. Heard learned counsel for the parties and perused the material made available on record. Taking into consideration the term of sentence & the submissions made at bar and without commenting upon the merits of the case, this Court deems it just and proper to suspend the sentences awarded to the applicant-appellants during pendency of these appeals. Accordingly, the applications for suspension of sentence are allowed and it is, hereby, ordered that the execution of sentences

(3 of 3) [SOSA-1497/2026] awarded to accused-applicants, namely Chainsingh S/o Ramkesh & Manoj S/o Kedar, by the learned Trial Court(s) shall remain suspended during pendency of the appeals, provided each of them furnishes a personal bond in the sum of Rs.50,000/- together with two sureties of Rs.25,000/- each, to the satisfaction of the learned Trial Court with the stipulation that they shall appear before this Court on 22.09.2026 and thereafter, as and when they are called upon to do so.
