1. Instant. misc. petition is filed by petitioners under Section 482 Cr.P.C. for quashing of proceeding in regular case No.462/2016 arising out of FIR No.457/2009 P.S. Kotwali, Bundi pending before learned Chief Judicial Magistrate, Bundi.

2. Learned counsel for petitioner submits that after filing of charge-sheet learned trial court has framed charge under Sections 420, 467/120B, 468/120B and 471/120B IPC against these petitioners but the parties have settled their dispute amicably as the dispute is private in nature and submitted a compromise to the trial court on 08.09.2017. He

[2026:RJ-JP:33430] (2 of 2) [CRLMP-5380/2017] also submits that trial court has attested the compromise under Section 420 IPC and acquitted the petitioners from the offence under Section 420 IPC but has not attested compromise in relation to other offences as same are non- compoundable.

3. Having considered the submissions and also the material placed on record, the dispute is of private in nature and the charge under Section 420 IPC has already been compounded by learned trial court therefore it is appropriate to invoke jurisdiction under Section 482 Cr.P.C. and quash the entire proceeding pending before CJM, Bundi or any other court to which matter is transferred.

4. Accordingly, the misc. petition is allowed and proceeding in criminal regular case No.462/2016 arising out of FIR No.457/2009 P.S. Kotwali, Bundi pending before learned Chief Judicial Magistrate, Bundi is quashed and set aside. The petitioners are discharged.

5. Misc. application, if any, stands disposed of. (ASHOK KUMAR JAIN),J 18/PREETI VALECHA
