Judgment

20/08/2026

1. Learned counsel for the petitioner submits that the present matter pertains to the Sub-Inspector (SI) Recruitment Examination, 2021. It is further submitted that the petitioner has not been convicted by any competent court of law as of date. It is argued that mere allegations or the mere registration of an FIR cannot be used as a ground to arbitrarily debar the petitioner from participating in future examinations, as such an action is entirely contrary to the applicable statutory rules and provisions.

2. Learned counsel additionally submits that the petitioner was previously employed with the State Government. Relying in regard

(2 of 3) [CW-12285/2026] of the aforesaid submission is placed upon the judgment passed by this Court in SB Civil writ Petition No. 13806/2024 titled Kailash Chand Sharma v. State and Ors. which has attained finality, and it is submitted that the petitioner is entitled to re- employment. However, learned counsel fairly submits that the relief of re-employment has not been pressed by way of the present petition and seeks liberty from this Court to file a fresh petition in this regard.

3. Per contra, learned counsel for the respondents, Mr. M.F. Baig, submits that SOG investigation is currently ongoing and an FIR has been registered against the petitioner by the respondents on allegations of using unfair means in the said public employment examination. Reliance in regard of the aforesaid submissions is placed upon the judgment passed by this Court vide order dated 12.08.2026 in SB Civil Writ Petition No. 12239/2026 titled Neeraj Kumar v. RPSC and Ors. and prays that the present petition, being on an equal footing, be disposed of in light of the said judgment.

4. Having heard the submissions advanced by learned counsel for the parties and considering the detailed order passed by this Court in Neeraj Kumar (supra), this Court finds that the case of the present petitioner is akin to the aforesaid matter.

5. Accordingly, this Court deems it appropriate to dispose of the present writ petition with direction to the respondents-authorities that the controversy involved herein shall be governed by the ratio encapsulated in the judgment dated 12.08.2026 passed in Neeraj Kumar (supra), which shall apply mutatis mutandis to the present petitioner.

(3 of 3) [CW-12285/2026]

6. It is further clarified that the aspect of the petitioner’s re- employment as a former State Government employee, in light of the judgment in Kailash Sharma (supra), is kept open and has not been adjudicated upon by this Court, as the same was not pressed by way of the present petition. The petitioner is at liberty to file a fresh writ petition before the appropriate forum in regard of the aforesaid, if so advised.

7. Accordingly, the present petition stand disposed of. Pending application(s), if any, shall also stand disposed of. (SAMEER JAIN),J 220/JUBIN
