Order

19/08/2026

1. Petitioner is tenant and is aggrieved by order dated 30.06.2026 passed by the Rent Tribunal in Application No.7/2015, not allowing to call for the duplicate rent receipt of the period prior to 01.03.2011 from the respondent-applicant, who in his evidence accepted that the duplicate rent receipts are in his power and possession and he may produce the same before the Court, if so required.

2. After arguing the writ petition for some time, counsel for petitioner submits that in view of the admission of respondent- applicant, if the duplicate rent receipts are not permitted to be called for, at least, it may be observed that in case the duplicate rent receipts are not produced on record by the respondent, an adverse inference should be drawn against respondent.

[2026:RJ-JP:33531] (2 of 2) [CW-15665/2026]

3. Taking into consideration the submission of counsel for petitioner, without interfering to the impugned order, instant writ petition stands disposed of with the observations that the Rent Appellate Tribunal may ponder over this aspect while deciding the present Eviction Petition No. 07/2015, finally on merits.

4. Stay application and other pending application(s), if any, also stand disposed of. (SUDESH BANSAL),J 10/NITIN
