1. The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 10.07.2026 passed by learned District and Sessions Judge, District Beawar, in Bail Appli- cation No.313/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No.154/2026, Police Station Saket Nagar, District Beawar for the offence under Section 108 of the BNS, 2023.
2. Learned counsel for the petitioner submits that the petitioner is in custody since 09.06.2026. He submits that the charge-sheet has been filed for the offence under Section 108 of the Bharatiya Nyaya Sanhita, 2023. He submits that, as per the F.I.R., the allegation against the petitioner is that the father of the deceased reported to the Police Authorities that his daughter, namely, Sarita
(2 of 5) [CRLMB-11204/2026] Devi, was married to one Gopal, but for the last seven years, there had been some dispute between his daughter Sarita Devi and her husband Gopal and was therefore, residing with her two children at her parents’ house. It is further alleged in the F.I.R. that when the son of Sarita Devi returned from school, he found that his mother had committed suicide by hanging herself. The complainant, who had gone to attend a social event, received the information and returned to his house, where he found that his daughter had committed suicide. The complainant found that some WhatsApp messages had been received from the mobile number of the present petitioner. The complainant has further stated in the F.I.R. that his daughter had committed suicide due to the abetment allegedly made by the person who had sent the WhatsApp messages.
3. Learned counsel for the petitioner submits that, thereafter, a thorough investigation was conducted and the charge-sheet has been filed under Section 108 of the Bharatiya Nyaya Sanhita, 2023, wherein the prosecution has set up a case that the present petitioner and the deceased used to communicate with each other through WhatsApp and telephone calls. Since the present petitioner had got married on 01.05.2026, upon receiving the said information, the deceased sent certain messages to the petitioner on WhatsApp, and in reply, the petitioner also sent messages on 06.05.2026, containing abusive language.
4. Learned counsel for the petitioner further submits that from the charge-sheet it has come on record that the petitioner had refused to marry the deceased and, therefore, she committed suicide. He however submits that the deceased was herself
(3 of 5) [CRLMB-11204/2026] married and had not obtained a divorce; therefore, there was no question of the petitioner marrying her, nor had any such assurance been given by him.
5. Learned counsel for the petitioner has placed reliance upon the judgment passed by the Hon’ble Apex Court in the case of Laxmi Das Vs. The State of West Bengal & Ors. ; 2025 INSC 86 whereby it has been held as under:- “14. It is discerned from the record that the Appellant along with her family did not attempt to put any pressure on the deceased to end the relationship between her and Babu Das. In fact, it was the deceased’s family that was unhappy with the relationship. Even if the Appellant expressed her disapproval towards the marriage of Babu Das and the deceased, it does not rise to the level of direct or indirect instigation of abetting suicide. Further a remark such as asking the deceased to not be alive if she cannot live without marrying her lover will also not gain the status of abetment. There needs to be positive act that creates an environment where the deceased is pushed to an edge in order to sustain the charge of Section 306 IPC.”
6. Learned counsel, therefore, prays that since the charge- sheet has already been filed, the conclusion of the trial is likely to take a considerable period of time, the petitioner may be enlarged on bail, particularly as he is in custody since 09.06.2026.
7. Learned Public Prosecutor vehemently opposes the bail application.
(4 of 5) [CRLMB-11204/2026]
8. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.
9. Without expressing any opinion on the merits of the case and upon consideration of the submissions advanced, and particularly the fact that the charge-sheet has been filed; the conclusion of the trial is likely to take a considerable period of time; the investigation agency has reported that the deceased committed suicide as the petitioner had refused to marry her however the deceased was herself married and had not obtained divorce; and taking into consideration the WhatsApp messages, this Court is of the opinion that the bail application deserves to be accepted.
10. Consequently, the bail application is allowed. It is ordered that the accused-petitioner - Pushpendra Singh @ Veeru S/o Ratan Singh arrested in connection with F.I.R. No. 154/2026, Police Station Saket Nagar, District Beawar, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/ (Rs. One Lakh Only) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand Only) each, to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so till the completion of the trial and with additional following conditions:
(i) The petitioner shall not leave country without the permission of the Court;
(ii) The petitioner shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected; and
(iii) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person
