Order
19/08/2026
1. In the civil suit for specific performance filed by respondent No.1, petitioners have been allowed to be impleaded on the prayer of respondent No.1-plaintiff vide order impugned dated 08.07.2026, hence, thereagainst instant writ petition has been filed by petitioner under Article 227 of the Constitution of India.
2. Submission of counsel for petitioners is that prior to passing of the impugned order, petitioners themselves moved an application under Order 1 Rule 10 CPC seeking their impleadment in the present suit, which was disallowed by the trial Court vide order dated 19.11.2024 (Ann-5), hence, thereafter, the impleadment of petitioners is bad in law.
3. This Court is of the considered opinion that the petitioners have been allowed to be impleaded on the prayer of plaintiff, who is master of his suit on the principle of dominus litis, hence, the previous order dated 19.11.2024 (Ann-5) does not have any material bearing on the order impugned.
(3 of 3) [CW-15762/2026] Further, in respect of other contentions as raised by counsel for petitioner, it is hereby observed that petitioners are at liberty to raise all their contentions in the written statement before the trial Court.
4. With the aforesaid observations, but without interference in the order impugned, instant writ petition stands disposed of.
5. Stay application and other pending application(s), if any, also stand disposed of. (SUDESH BANSAL),J 11/NITIN
