19/08/2026

1. By way of instant contempt petition, petitioner-landlord (decree-holder) has alleged disobedience of the final order dated 12.09.2023 passed in S.B. Civil Second Appeal No. 234/2023, whereby, while disposing of the second appeal preferred by defendant (respondent-contemnor herein), he was directed to vacate the rented premises and hand over the peaceful possession thereof, subject to certain conditions.

2. Learned counsel for the petitioner, having instructions, submits that possession of the rented premises has been received and no further compliance remains due. In view thereof, petitioner does not want to press the present contempt petition on merits and seeks permission to withdraw the same.

3. Respondents have no objection.
