1. By way of this criminal misc. petition under Section 528 of the B.N.S.S., the accused-petitioners have approached this Court with a prayer to quash the FIR No.357/2019 registered at Police Station Kotwali Baran, District Baran for the offences punishable under Sections 341, 323, 504 & 143 of the IPC along with criminal proceedings arising out of it, on the basis of compromise arrived at between the parties.

2. After registration of the aforesaid FIR, the police conducted investigation in the matter and filed final report under Section 173

(2 of 3) [CRLMP-5380/2026] Cr.P.C. before the learned court below against the petitioners for the offences punishable under Sections 341, 323, 324, 325, 326, 147, 148, 149 & 504 of the IPC.

3. Learned counsel for the petitioners submits that during the pendency of the criminal proceedings, dispute has been resolved by the parties amicably. Counsel submits that on 17.06.2022, both the parties filed an application for compounding the offences punishable under Sections 341, 323, 324, 325, 326, 147, 148, 149 & 504 of the IPC. It is stated in the application that the parties have resolved their dispute amicably and entered into a compromise. Counsel submits that on account of compromise, further proceedings in the impugned FIR are fruitless and continuation thereof would be a futile exercise and a waste of precious judicial time and resources.

4. The trial Court partly allowed the application and permitted to compound the offences under Sections 341, 323, 325 & 504 of the IPC vide order dated 17.06.2022 but the prayer in respect of other offences were not accepted as the same are not compoundable.

5. In these circumstances, the petitioners have approached this Court by way of this petition to quash the FIR alongwith entire proceedings on the ground that the parties have resolved their dispute.

6. Learned counsel appearing on behalf of the complainant/victim does not dispute the factum of compromise and submits that complainant has no objection if this petition is allowed and impugned FIR lodged against the petitioner is

(3 of 3) [CRLMP-5380/2026] quashed on the basis of amicable settlement arrived at between the parties.

7. In view of the aforesaid and considering the submissions made on behalf of the respective parties; the material made available for my perusal; considering that the petitioners and the complainant have resolved their dispute amicably, this Court is of the view that in order to establish peace and harmony between the petitioners and complainant and in order to let them live peacefully in the future life, and also finding that the present case is wholly covered by the principle of law laid down by Hon'ble the Supreme Court in the case of Gian Singh Vs. State of Punjab & Anr-reported in 2012 Cr.L.J. (SC) 4934 and in the case of State of Haryana & Ors. Vs. Choudhary Bhajan Lal & Ors. [AIR 1992 SC 604], the impugned FIR and all subsequent criminal proceedings are liable to be quashed in view of compromise arrived at between the parties although the remaining offences alleged to be made out in the instant case is not compoundable.

8. In view of the above, this criminal misc. petition is allowed and the FIR No.357/2019 registered at Police Station Kotwali Baran, District Baran along with criminal proceedings arising out of it are quashed and set aside. Consequence to follow.

9. Stay application(s), if any, also stands disposed of. (ANIL KUMAR UPMAN),J 236/Dushyant
