1. The instant bail application has been filed under Section 483 BNSS on behalf of the accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.241/2026 registered at Police Station-Vijay Nagar, District-Beawar for the offences under Sections 8/15 of Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the recovery of afeem doda post chura from the possession of the accused-petitioner is 27 Kg. 640 grams, which is below the commercial quantity. He submits that the co- accused-Amarjeet Kaur has already been enlarged on bail by the Co-ordinate Bench of this Court. He further contended that the

(2 of 3) [CRLMB-12172/2026] accused-petitioner is behind the bars since 17.06.2026 and trial of the case may take considerable time and there is no other criminal antecedent registered against the accused-petitioner, therefore, he prayed that the bail application of the accused-petitioner may be allowed.

3. Learned Public Prosecutor has vehemently opposed the bail application.

4. Heard and perused the material available on record.

5. In the present case, the accused-petitioner is in custody since 17.06.2026 and recovered contraband article is less than commercial quantity and the co-accused-Amarjeet Kaur has already been enlarged on bail by the Co-ordinate Bench of this Court. Considering the arguments advanced by the learned counsel for the petitioner, looking to the facts of the case and without commenting anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail.

6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused/petitioner-Vikas Kumar S/o Ramchandra, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
